viewers, janet napolitano has been in staten island touring that devastated area. here she is right now. let's listen in. >> we know that staten island took a particularly hard hit from sandy. and so we want to make sure that the right resources are brought here as quickly as possible to help this community which is so very strong recover even more quickly. just to give you a sense of an overview, it's been mentioned that this was a large storm. the area that sandy covered was roughly the size of europe. we had major disasters in a number of states that president obama already has declared emergency declarations in a number of states that have been declared. we have seen some huge impacts on things like the availability of power. and with of course the loss of power comes attendant losses on things like gasoline. so all of these things, all of these issues being worked now as the community comes back and as we work to support con ed and other utility companies in getting the grid back on. we have over 75,000 survivors in new york and new jersey who now have applied for disaster assistan

voting delay? is that legal? judge? >>judge napolitano: you never is the easy questions, it is enormously complex question. the voting for president of the unis not exactly for the president. it is for electors to choose a president. we are familiar with the electoral college, after gore won the popular and bush won the electoral vote. so we start with that, we do not elect the president we elect electors, the state can choose to designate the electors however they want. the electors for obama or for romney, but if a state wanted to the legislature could choose the electorate rather than having election. they would be voted out of office but they could do it. with those premises in place, the question is, can a state delay an election? yes but not for president. federal law has said you must choose your electors on the first monday after the first tuesday of november. this year, november 6. so the state of new jersey, where we live, for example, could delay congressional elections by a month because they felt candidates could not campaign because of the hurricane but it could not delay th

security secretary janet napolitano toured the area, vowing to do everything she could to help. plus, after insisting this sunday's new york city marathon would go on, mayor bloomberg canceled the race. many were outraged the city would take valuable efforts away from the recovery efforts for the marathon. tonight, city hall and race officials have called it off. meanwhile, look at this. cars lined up for miles to get gas. drivers in some cases waiting 20 hours as the supply dwindles, fighting with each other. there's one report that a guy pu pulled a gun at one gas station. tonight the military is delivering fuel to the disaster zone, sending 24 million gallons of extra gas, a welcome sign. the obama administration is hiring trucks to bring the gas to staging areas. all this is unfolding four days before the general election. president obama and governor romney fighting it out for every last vote, especially in the key state of ohio. today the latest cnn poll shows obama with a very slight edge there, but there's everything to play for. today, the last jobs report before election day was r

. the judge is in the house, judge napolitano. after hurricane andrew they did this in an drew back in 1982 and people went crazy and they prosecuted people and they put them in jail for it. >>judge napolitano: most states do not prosecute. i am familiar with the case but not a lost them. they are very heavy with respect to fines and they are not fines imposed after a trail, these are fines imposed by an inspector on-the-spot and it is difficult to challenge the discretion. an example, some of the fines are serious. at a gas station in new jersey which is not far from where i live in the northwest corner of new jersey, a gas station was fined $50,000 for raising the price of gas more than 10 percent for a day. the guy cld not pay the $50,000 so the state took over the gas station, and they didn't know what to do with the gas station so they sold it back to the oil company who sold to someone else. that was a very stiff fine. the governor is serious. he has dispatched a lot inspectors to make sure this doesn't happen. gas seems to be the issue. we talked about batteries and other things but

recover even more quickly. >> secretary napolitano told reporters today they had fema and the national guard on the ground in the northeast with more to come. over 75,000 survivors have applied for federal disaster assistance already and the governor has already given out $15 million in aid. more than 8.7 million liters of water are in place for victims along with 2.6 million meals. the red cross has 258 shelters open across the region. federal officials are moving generators to hospitals and nursing homes still without electricity and the department of defense is helping to air lift utility crews into affected areas to get the lights back on. in new york, officials have restored power to more than 375,000 homes and businesses. people cheered when the lights came back on, gasoline is still tough to come by with lines stretching several miles in some locations across new york and new jersey today. some locations are still without electricity. so the gas cannot be pumped. officials have reopened the port of new york allowing more supplies in including fuel tankers brinking more than 200

. what can you tell us? >> well, janet napolitano, the head of homeland security was there. we have a coordinated response now since 9/11, and the head of fema, who is coordinating the response of all the federal agencies, craig fugate, they are sending federal aid. they are sending generators down tomorrow. all of our tunnels are flooded. it is the worst flooding that the nta has had in 100 years and the worst outage in the history of con edison. con ed does not have the power to clean the tunnels out so the mta can see how it needs to be repaired. the federal government is coming in with generators, with emergency aid. i just got off the phone earlier today with ray lahood, the head of the transportation, and he's working with fema and with napolitano to get aid to the city of new york and the resources. they are coordinating responses with the red cross and others in terms of food, water, and seeing that people down on the lower east side where i was working today, it's the american spirit as the president said, people at their brightest. >> it's the american spirit, but it's als
